This clause should be placed under the "Dispute Resolution" section of the agreement or a similar heading by ensuring that there are no conflicting clauses regarding dispute resolution, arbitration.

“Any dispute, controversy or claim arising out of or relating to this contract, including its construction, interpretation, scope, operation, or validity (“Dispute”), shall first be referred to mediation administered by ODR Nexus in accordance with its Mediation Rules. If mediation is unsuccessful or non-starter for any reason, the Dispute shall immediately be escalated to Arbitration and finally resolved by online arbitration administered by ODR Nexus under its Arbitration Rules.
The arbitration shall be conducted before a sole arbitrator appointed under the Rules. The juridical seat shall be [●], India, and the governing law shall be Indian law. The arbitration shall be conducted in English, and the arbitrator’s decision shall be final and binding. Subject to the above, the competent courts at the seat shall have exclusive jurisdiction.
